Edit: I've been thinking about this. I really don't know. Is it possible that he can get away with firing smokers or overweight people because it saves his company money? Maybe smokers, but there are many reasons people could be overweight. Would this constitute discrimination at some point?
Honestly, I'm 100% for banning smoking in all public places, particularly workplaces. I think second-hand smoke makes a good case for an unsafe working environment. But this is bizarre.
